Terms of Service

By creating an LC Pilot account or using lcpilot.com, you ("you") agree to these Terms of Service ("Terms") with LC Pilot ("we", "us", "LC Pilot"). If you don't agree, don't use the service.

1. What LC Pilot Does

LC Pilot provides tariff and landed cost calculation tools for ecommerce sellers, dropshippers, and importers. We help you estimate the true cost of importing products into the United States by combining publicly available tariff data, marketplace fees, and shipping cost inputs into a single landed cost number.

2. Estimates, Not Customs Advice

All tariff and landed cost figures are estimates only, based on published USITC HTS rates, the Federal Register, and other public sources. Actual duties assessed at the port of entry can differ based on:

For shipments over $10,000 customs value, or any HS code with active AD/CVD orders, consult a licensed customs broker before ordering. LC Pilot is not a customs broker, customs lawyer, or tax advisor. Our calculations don't constitute legal, customs, or financial advice.

3. Your Account

You're responsible for keeping your password secure and for everything that happens under your account. Notify us immediately at support@lcpilot.com if you suspect unauthorized access. You must be 13 or older to create an account; we don't knowingly collect data from children under 13 (see our Privacy Policy for the COPPA section).

4. Subscriptions and Billing

Paid subscriptions are billed monthly or annually via Stripe. You authorize us to charge your selected payment method on each renewal date until you cancel. You can cancel anytime from Settings → Billing — cancellation takes effect at the end of the current billing period, and you keep paid features until then.

5. Refund Policy

7-day money-back guarantee on every paid plan. Cancel within 7 days of your first paid charge for a full refund — no questions, no forms. Email support@lcpilot.com. Refunds process within 5-10 business days back to your original payment method.

After day 7: Subscriptions are non-refundable for the current billing period, but you can cancel anytime to stop future charges. Annual plans: same 7-day window. After that, annual subscriptions aren't pro-rated, but we won't auto-renew without warning, and any auto-renewal charge can be reversed with one email if flagged within 30 days.

6. Pricing Changes

We may change subscription prices for new sign-ups at any time. For existing paid subscribers, we'll give you at least 30 days' notice before any price increase, sent to the email on your account, with the new price taking effect on your next renewal after the notice period. You can cancel before the new price takes effect. Promotional pricing (e.g. founder rates, annual discount) is locked for the initial billing period and won't increase retroactively.

We may suspend or terminate accounts that violate this section without refund if the violation is material or repeated.

8. Account Termination

By you: Cancel your subscription anytime from Settings, or delete your account permanently from Settings → Delete Account. Account deletion removes all your saved calculations, products, alerts, team memberships, and subscription state within 14 days; some audit logs are retained for security/forensics for up to 90 days (info-severity), 180 days (warnings), or 2 years (critical security events).

By us: We may suspend or terminate your account with notice for material breach of these Terms (including the Acceptable Use section), non-payment after a reasonable cure period, or activity that creates legal/security/operational risk. We'll give you at least 30 days' notice except for emergency situations (security incident, abuse, fraud, AUP violation in progress) where immediate action is necessary. On termination by us, you can request your data export within 30 days; after that, normal account-deletion retention applies.

9. Intellectual Property

LC Pilot, the LC Pilot logo, the calculation engine, and all software are owned by us. You get a non-exclusive, non-transferable, revocable license to use the service for your business while your subscription is in good standing. Tariff rate data sourced from USITC is public-domain US government data; our compilation, presentation, and value-add (AD/CVD overlay, marketplace fee blending, viability scoring) is ours.

You retain ownership of your inputs (product names, costs, supplier countries, HS-code selections) and calculation outputs. We don't claim rights over your data and don't use it to train AI models.

10. DMCA / Copyright

If you believe content on LC Pilot infringes your copyright, send a DMCA notice (17 U.S.C. § 512) to:

Your notice must include: identification of the copyrighted work; the URL of the allegedly infringing content; your contact info; a good-faith statement that the use isn't authorized; a statement under penalty of perjury that the info is accurate and you're the copyright owner or authorized agent; and your physical or electronic signature. We'll respond within a reasonable time and may remove material in compliance with the DMCA safe-harbor.

11. AS IS — No Warranty

LC PILOT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED SERVICE. We don't warrant that calculations will match the duties actually assessed at the port of entry, or that USITC/AliExpress/OpenAI/Stripe upstream services will be available on demand.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LC PILOT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID LC PILOT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions don't allow exclusion of certain warranties or limitation of certain damages, so the above may not fully apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless LC Pilot, its officers, employees, and contractors from any claim, loss, damage, or expense (including reasonable attorneys' fees) arising out of: (a) your violation of these Terms; (b) your misuse of the service or violation of any law; (c) your import or sale of products using LC Pilot calculations, including any customs duty assessment, AD/CVD penalty, transshipment fraud penalty, or seizure that results from your supplier's actual country of origin or HS classification differing from what you calculated against; (d) your infringement of any third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before filing any formal claim, you agree to contact us at legal@lcpilot.com and try to resolve the dispute informally for at least 30 days.

Binding arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Indianapolis, Indiana, by a single arbitrator. Judgment on the award may be entered in any court with jurisdiction. YOU AND LC PILOT WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. Disputes must be brought in your individual capacity. You may opt out of this arbitration provision by emailing legal@lcpilot.com within 30 days of account creation.

Exception: Either party may bring a claim in small-claims court for disputes that qualify, and either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement.

15. Privacy and Data

How we collect, use, and store data is described in our Privacy Policy. You can export all your data anytime from Settings (or via /api/profile/export), correct profile information from Settings → Profile, opt out of analytics from Your Privacy Choices, and delete your account permanently from Settings → Delete Account.

Do Not Track: Your browser may send a "Do Not Track" (DNT) signal. There's currently no industry-standard interpretation of DNT, so we don't respond to it specifically — but our cookie banner and Privacy Choices page give you the same opt-out controls (analytics, advertising) that DNT was meant to convey. We also honor the Global Privacy Control (GPC) signal as described in the Privacy Policy's CCPA section.

16. Data-Breach Notification

If we discover a security incident that compromises your personal information, we'll notify you via the email on your account within 72 hours of discovery (or as required by applicable law, including GDPR Article 33 and US state breach-notification laws). The notice will describe the nature of the incident, the categories of data potentially affected, the steps we're taking, and what you can do to protect yourself.

17. Changes to These Terms

We may update these Terms periodically. For material changes, we'll notify you via email at least 30 days before the change takes effect, with a highlighted summary of what's changing. Continuing to use LC Pilot after the effective date means you accept the new Terms; if you don't agree, cancel before the effective date for a pro-rated refund of any unused subscription period.

18. Survival

Sections that by their nature should survive termination — IP ownership (§9), AS-IS (§11), Limitation of Liability (§12), Indemnification (§13), Governing Law and Disputes (§14), and this Survival clause — survive termination of these Terms or your account.

19. Miscellaneous

These Terms, together with the Privacy Policy and any separate agreement we sign with you, are the entire agreement between us regarding LC Pilot. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You can't assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of substantially all assets.
